A. General Terms and Conditions (GTC)

  • 1 Scope and provider
    1.1
    These terms and conditions apply to all orders placed through the company's online shop.

All deliveries and services provided by us are subject to the following terms and conditions in the version valid at the time of your order.

Consumers within the meaning of Section 13 of the German Civil Code (BGB) and these General Terms and Conditions are natural persons with whom we enter into business relationships without this being predominantly attributable to their commercial or independent professional activity.

Individual contractual agreements take precedence over these General Terms and Conditions. Deviating, conflicting, or supplementary General Terms and Conditions will not become part of the contract unless their validity is expressly agreed to.

  • 2. Offer in the online shop and conclusion of contract

    The product descriptions in our online shop serve as an invitation to submit a purchase offer and merely constitute an invitation to place an order. To place an order with us, you add items to your shopping cart, enter your delivery and payment details, provide your email address so we can inform you about your right of return and send you the contract text, confirm the accuracy of your information in the order summary, and finally click the "Buy Now" button. By clicking the "Buy Now" button, you submit a binding purchase offer. Our products are sold only for private use and in quantities typical for a household.

We can accept your order by sending order confirmations via email or by delivering the goods within two days of receiving your order. Confirmation of receipt of the order does not yet constitute acceptance of the purchase offer. If the consumer orders the goods electronically, we will confirm receipt of the order immediately. The confirmation of receipt lists the details of the order. It does not constitute a binding acceptance of the order, but merely serves to inform you that we have received your order. However, it may be combined with a declaration of acceptance. You will receive all customer information from us no later than upon delivery of the goods, which you should print for your records. You agree that you may also receive your invoices electronically (as a PDF via email).

2.3
Should our order confirmation contain typographical or printing errors, or should the presentation and determination of product prices be based on technically caused transmission errors, we are entitled to contest the order. In the context of such a contestation, we must prove our error to you. Any payments already made by you will be refunded immediately.

2.4
Consumers must be at least 18 years old to order goods from us. In case of doubt, the consumer must provide proof of age. The requirement to provide age is due to the payment methods we use.

Even repeated acts of goodwill on our part do not establish any entitlement for the future.

    The prices listed on the product pages of the online shop www.amip-firenze.com include statutory VAT and other price components and are exclusive of applicable shipping costs in EURO (€).
  • 4 Shipping costs

4.1
For shipping within Germany, we charge €4.99 per order for postage and packaging. This flat rate is reduced to €0 for orders over €69.00. For shipping within the EU, we charge €14.99 per order for postage and packaging. This flat rate is reduced to €0 for orders over €130.00 for EU shipments. For particularly bulky items, we charge an additional €7.99 per item on top of the shipping costs. You can find the relevant information and the amount of the surcharge in the respective product description.

No further taxes or costs will be incurred.

4.4
With the updating of the website, all previous prices and other information about goods become invalid. The information displayed at the time you order the goods is definitive.

  • 5. Delivery conditions and reservation of self-supply
    5.1
    The delivery area and the respective conditions are determined according to our shipping conditions in the online shop at ( www.amio-firenze.com ). (Shipping conditions). Delivery usually takes 2–8 working days. For further information regarding delivery, please refer to sections 5.3 and 5.4 of the terms and conditions.

5.2
Should not all ordered products be in stock, we are entitled to make partial deliveries of products at our own expense, provided this is reasonable for you.

5.3
If the shipment is being sent via a freight forwarder, the forwarder will contact you to arrange a delivery date.

5.4
If the delivery is a parcel, the sender will make up to two delivery attempts. If the delivery driver cannot reach you personally, they will leave the parcel with a neighbor. If the driver is also unable to find anyone at home on the second attempt, the parcel will be stored at the nearest post office. You will then have 7 business days to claim the parcel before it is returned to us.

5.5
If the ordered product is unavailable because it is economically impossible for us to procure it for you through no fault of our own, we have the right to withdraw from the concluded purchase agreement. In this case, we will inform you immediately. We will refund any payments you have already made.

  • 6. Payment terms
    6.1
    Payment can be made via the online shop using your choice of credit card (Mastercard, VISA, Maestro, American Express, UnionPay), Shop Pay, Apple Pay, Google Pay, Bancontact, eps transfer, iDEAL, Klarna, or Sofortüberweisung. Payments are processed and accepted via Shopify Payments.

6.2
Should you fall behind on payment, the Amio online shop reserves the right to charge a reminder fee of €1.00 for each subsequent reminder. You are entitled to prove at any time that the fees charged were lower in a specific case. In that case, you are only obligated to pay the lower amount.

6.3
From the date of default, you are additionally required to pay interest on the invoiced amounts at a rate of five percentage points above the base interest rate.

6.4
When paying by credit card, the amount is reserved on your credit card (authorization) when you place your order. Your credit card will only be charged when we ship the goods to you. In the event of a return, we will credit the amount back to your credit card account as quickly as possible after your return has been processed in our logistics center.

6.5
When selecting instant bank transfer as your payment method, you can pay conveniently, easily, and securely without registration. All you need are your online banking details. Afterwards, you can simply pay using your bank code, account number, PIN, and TAN. More information is available at https://www.sofort.de .

6.6
You can also pay for your order using PayPal. For this, you need a valid PayPal account, which you can open at www.paypal.com . If you select this payment method, you will need to enter your email address and password into the PayPal input form displayed at the end of the checkout process. The total amount due, including shipping costs, will be credited to our account immediately. Shipping will take place after PayPal confirms payment. Please note that when selecting PayPal as your payment method, the "PayPal Terms of Use" of PayPal (Europe) S.à rl & Cie, SCA apply. The terms of use that govern your contractual relationship with PayPal (Europe) S.à rl & Cie, SCA can be found at www.paypal.com .

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the option of paying by invoice. The payment period is 14 days from the date of dispatch of the goods/tickets or, in the case of other services, from the date the service is made available. Payment is made to Klarna. Please note that payment by invoice is only available to consumers and that the use of this payment method requires a positive credit check. You can find the complete terms and conditions for payment by invoice for deliveries to Germany here . Klarna checks and evaluates your data and, where there is a legitimate interest and reason, exchanges data with other companies and credit agencies. Your personal data will be processed in accordance with applicable data protection regulations and as described in Klarna's privacy policy.

  • 7 Right of withdrawal for consumers
    7.1
    Consumers have a right of withdrawal of 14 days. Consumers within the meaning of § 13 of the German Civil Code (BGB) are natural persons with whom we enter into business relationships without this being predominantly attributable to a commercial or independent professional activity.

Cancellation policy

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last goods.

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of the revocation
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

We do NOT cover the costs of returning the goods.
You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.

Notice regarding the non-existence of the right of withdrawal:
The right of withdrawal does not apply to distance contracts for the supply of goods which are liable to deteriorate or expire rapidly, or to distance contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery.

7.2
You must prevent damage and contamination of the ordered products during return shipping by using appropriate packaging. If possible, return the goods to us in their original packaging with all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, ensure adequate protection against transport damage with packaging suitable for the respective product in order to avoid claims for damages against you due to inadequate packaging.

7.3
Please note that when purchasing sealed hygiene products (e.g., towels, bathrobes, changing mats, underwear, socks, etc.), these products require particularly careful handling due to their nature. Therefore, if you decide after receiving the goods that you wish to exercise your right of withdrawal, we kindly ask you not to use the items in question. This does not affect the statutory exclusion of the right of withdrawal for certain categories of goods.

7.4
Please note that the modalities for exercising the right of withdrawal mentioned in the preceding paragraphs 7.2, 7.3 and 7.4 are not a prerequisite for the effective exercise of the right of withdrawal in distance contracts.

  • 8. Agreement on the exercise of the right of withdrawal by consumers through the return of goods
    Consumers as defined in Section 13 of the German Civil Code (BGB) and Section 1.4 of these Terms and Conditions have the option of exercising their right of withdrawal for distance contracts by returning the goods. For the effective and timely exercise of the right of withdrawal within the 14-day withdrawal period as outlined in the cancellation policy, the consumer is obligated to clearly mark the returned goods in such a way that Amio Germany GmbH can recognize the return as a withdrawal. If multiple items suitable for parcel shipping are returned to us in one shipment, the consumer must clearly indicate which of the returned items are to be included in the exercise of the right of withdrawal for distance contracts.

If the goods that can be sent by parcel are not marked when several goods are returned, or if a return is not marked or designated as a cancellation, then the right of cancellation by return is not effective and has not been exercised in due time, subject to further options for cancellation used by the consumer.

  • 9 Transport damages
    9.1
    If goods are delivered with immediately recognizable and therefore obvious transport damage, please report such defects to the delivery person immediately and contact us as soon as possible:

Please provide your order and/or invoice number, as well as the tracking number you received. We recommend documenting any transport damage with a photo and attaching it to your email.

9.2
Failure to file a complaint or contact us regarding transport damage does not affect your statutory warranty rights. However, your action will help us to assert our own legal claims against the carrier or any applicable transport insurance.

  • 10 Liability
    10.1
    We are only liable for intentional misconduct and gross negligence. Insofar as an attributable breach of duty is based on simple negligence and a material contractual obligation (obligations whose fulfillment is essential for the proper execution of the contract, whose breach jeopardizes the achievement of the contractual purpose, and on whose compliance you as the customer regularly rely) is culpably breached, our liability for damages is limited to the foreseeable damage that typically occurs in comparable cases. In the event of injury to life, body, or health, we are liable in accordance with statutory provisions. The statutory warranty rights apply (§ 434ff BGB, 2 years).

10.2
Liability under the provisions of the Product Liability Act remains unaffected. Liability for slight negligence is limited to essential contractual obligations.

  • 11 Final Provisions
    11.1
    Should any provision of these terms and conditions be invalid, the remainder of the contract shall remain in effect. The relevant statutory provisions shall apply in place of the invalid provision.

11.2
German law applies to the conclusion and execution of all contracts. However, this only applies to you as a consumer to the extent that the protection afforded to you by mandatory provisions of the law of the state in which you have your habitual residence is not withdrawn.

11.3
The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) do not apply.

Disclosure obligation pursuant to the Consumer Dispute Resolution Act (VSBG): Amio Germany GmbH declares in advance that it is not prepared to participate in dispute resolution proceedings before consumer arbitration boards within the meaning of Section 36 Paragraph 1 of the Consumer Dispute Resolution Act (VSBG). This does not affect the possibility of dispute resolution by a consumer arbitration board during or in the course of a specific dispute with the consent of both contracting parties (Section 37 VSBG).

3.1 Customer order/offer process
If the customer finds a product in the seller's selection that meets their needs, they can add it to their shopping cart. To view their shopping cart, the customer can do so at any time by clicking the "Shopping Cart" button. Products that the customer no longer wishes to order can be changed or deleted at any time by clicking the "Change Item" button (to change the quantity) or the "Delete Item" button (to remove the selected item from the shopping cart). After all desired items have been added to the shopping cart, the customer must enter their information. The seller has clearly marked the fields where the customer must provide the required information for the proper processing of the order. Finally, the customer can click the "Buy Now" button.   2. Information on technical means for detecting and correcting input errors
    Before completing the order, the customer can correct their information at any time. This applies to both the quantity of ordered items and the selected items themselves. To do this, the customer can modify their information using the mouse or keyboard, removing items from the shopping cart as well as increasing or decreasing the quantity of individual items. Furthermore, all order details are displayed again before the order is finalized, allowing the customer to make corrections.
