    These General Terms and Conditions apply to all orders placed via the online shop of the company

All deliveries and services provided by us are subject to the following General Terms and Conditions in the version valid at the time of your order.

Consumers within the meaning of Section 13 of the German Civil Code (BGB) and these General Terms and Conditions are natural persons with whom we enter into business relationships without this being predominantly attributable to their commercial or independent professional activity.

Individual contractual agreements take precedence over these General Terms and Conditions. Differing, conflicting, or supplementary General Terms and Conditions shall not become part of the contract unless their validity is expressly agreed upon.

  • 2 Offer in the online shop and conclusion of contract
    2.1
    The product presentations in the online shop are intended to constitute a purchase offer on your part and merely an invitation to place an order. You place an order with us by placing items in your shopping cart, entering your delivery and payment details, providing your email address so that we can inform you of your right of return by email and send you the contract text, confirming the accuracy of your information in the checkout overview, and finally clicking the "Buy now" button. By clicking the "Buy now" button, you submit a binding offer to purchase. Our products are sold only for private use in normal household quantities.

We can accept your order by sending order confirmations by email or by delivering the goods within two days of receiving your order. Confirmation of receipt of the order does not constitute acceptance of the purchase offer. If the consumer orders the goods electronically, we will confirm receipt of the order immediately. The confirmation of receipt lists the details of the order. It does not constitute a binding acceptance of the order, but is only intended to inform you that we have received the order. However, it can be combined with a declaration of acceptance. You will receive all customer information from us no later than by the time the goods are delivered, which you should print out for your records. You agree that you may also receive your invoices electronically (as a PDF by email) from us.

2.3
Should our order confirmation contain any typographical or printing errors, or should the presentation and determination of product prices be based on technical transmission errors, we reserve the right to contest the order. In the context of the contestation, we must prove our error to you. Any payments already made by you will be refunded immediately.

2.4
The consumer must be at least 18 years old to order goods from us. In case of doubt, the consumer must provide proof of age. The necessity of providing age information arises from the payment methods we use.

Even repeated goodwill services by us do not constitute a claim for the future.

    The prices listed on the product pages of the online shop www.amip-firenze.com include VAT and other price components and are exclusive of any applicable shipping costs.
  • 4 Shipping costs

4.1
For parcel delivery within Germany, we charge €5.99 per order for postage and packaging. For orders over €89.00, the flat rate for postage and packaging is reduced to €0. For particularly bulky items, we charge a surcharge of up to €6.99 per bulky item in addition to the shipping costs. The relevant information and the amount of the surcharge can be found in the respective item description.

4.2
There are no additional taxes or costs.

4.4
When the website is updated, all previous prices and other information about goods become invalid. The information at the time you order the goods shall prevail.

  • 5 Delivery conditions and reservation of self-supply
    5.1
    The delivery area and the respective conditions are determined by our shipping conditions in the online shop at ( www.amio-firenze.com - Shipping Conditions). For further information regarding delivery, please refer to sections 5.3 and 5.4 of the General Terms and Conditions.

5.2
If we do not have all of the products you have ordered in stock, we are entitled to make partial deliveries of products at our own expense, provided this is reasonable for you.

5.3
If the shipment is a freight forwarding service, the freight forwarder will contact you to arrange a delivery date.

5.4
If the parcel is being sent, the sender will make up to two delivery attempts. If the courier cannot reach you personally, they will leave the parcel with your neighbor. If the courier cannot find anyone on the second attempt, the parcel will be stored at the nearest post office. You then have seven business days before the parcel is returned to us.

5.5
If the ordered product is unavailable because it is economically impossible for us to procure it for you through no fault of our own, we reserve the right to withdraw from a concluded purchase contract. In this case, we will notify you immediately. We will reimburse you for any consideration you have already provided.

  • 6 Payment conditions
    6.1
    Payments can be made via the online shop by credit card (Mastercard, VISA, Maestro, American Express, UnionPay), Shop Pay, Apple Pay, Google Pay, Bancontact, eps-Überweisung, Ideal, Klarna, and Sofortüberweisung. Payments are processed and accepted via Shopify Payments.

6.2
Should you default on payment, the Amio online shop reserves the right to charge a reminder fee of €1.00 for any subsequent reminders. You reserve the right to prove at any time that the fees claimed were lower in the individual case. In this case, you are only obligated to pay the lower amount.

6.3
From the date of default, you will also be required to pay interest on the amounts invoiced by us at a rate of five percentage points above the base interest rate.

6.4
When paying by credit card, the amount will be reserved on your credit card when you place your order (known as an authorization). Your credit card will actually be charged when we ship the goods to you. In the event of a return, we will credit the amount back to your credit card account as soon as possible after your return has been processed at our logistics center.

By choosing Sofortüberweisung as your payment method, you can pay conveniently, easily, and securely without registering. All you need is your online account information. You can then easily pay using your bank code, account number, PIN, and TAN. More information is available athttps://www.sofort.de .

You can also pay for your order using PayPal. You will need a valid PayPal account, which you can open atwww.paypal.com . If you select this payment method, you will need to enter your email address and password into the PayPal input mask displayed at the end of the order process. The payment amount due for your order, including any applicable shipping costs, will be credited to our account immediately. Shipping will occur after PayPal has confirmed payment. Please note that if you select PayPal as your payment method, the "PayPal Terms of Use" of PayPal (Europe) S.à rl & Cie, SCA apply. In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you purchase on account as a payment option. The payment period is 14 days from dispatch of the goods/ticket/or, in the case of other services, the provision of the service. Payment is made to Klarna. Please note that purchase on account is only available to consumers and that the use of this payment method requires a positive credit check. The complete terms and conditions for purchase on account for deliveries to Germany can be found here . Klarna checks and evaluates your data and, where there is a legitimate interest and reason, exchanges data with other companies and credit agencies. Your personal data will be treated in accordance with applicable data protection regulations and in accordance with the information in Klarna's privacy policy.

  • 7 Right of withdrawal for consumers
    7.1
    Consumers have a 14-day right of withdrawal. Consumers within the meaning of Section 13 of the German Civil Code (BGB) are natural persons with whom we enter into business relationships without this being predominantly attributable to a commercial or self-employed professional activity.

Cancellation policy

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last partial shipment or the last item.

by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send your notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

We do NOT cover the cost of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

Note on non-existence of the right of withdrawal:
The right of withdrawal does not apply to distance contracts for the delivery of goods that are liable to deteriorate quickly or whose expiry date would be quickly exceeded, or to distance contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

7.2
You must use appropriate packaging to prevent damage and contamination of the ordered products that may occur during return shipment. If possible, return the goods to us in their original packaging, including all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage by using packaging suitable for the respective product to avoid claims for damages caused by inadequate packaging.

7.3
When purchasing hygiene products (e.g., towels, bathrobes, swaddling blankets, underwear, socks, etc.), please note that due to their nature, these products require particular care. Therefore, if you notice after receiving the goods that you wish to exercise your right of withdrawal, we ask you not to use the goods in question. The statutory exclusion of the right of withdrawal for certain categories of goods remains unaffected.

7.4
Please note that the modalities for exercising the right of withdrawal set out in paragraphs 7.2, 7.3 and 7.4 above are not a prerequisite for the effective exercise of the right of withdrawal in distance selling contracts.

  • 8 Agreement on the exercise of the right of withdrawal by consumers by returning goods
    Consumers within the meaning of Section 13 of the German Civil Code (BGB) and Section 1.4 of these General Terms and Conditions have the option of exercising their right of withdrawal for distance selling contracts by returning the goods. In order to effectively and timely exercise their right of withdrawal within the 14-day withdrawal period in accordance with the withdrawal policy, the consumer is obligated to expressly mark the goods upon return so that the return can be recognized by Amio Germany GmbH as a withdrawal. If several items that can be sent by parcel post are returned to us within one return shipment, the consumer must clearly indicate which of the returned goods are to be covered by the exercise of the right of withdrawal for distance selling contracts.

If the goods that can be sent by parcel are not marked when multiple goods are returned, or if the return is not marked or designated as a cancellation, the right of cancellation by returning the goods is not effective and has not been exercised in a timely manner, subject to any other cancellation options used by the consumer.

  • 9 Transport damage
    9.1
    If goods are delivered with immediately recognizable and therefore obvious transport damage, please report such defects to the deliverer immediately and contact us as soon as possible:

Please provide your order and/or invoice number, as well as the tracking number you received. We recommend that you document any transport damage with a photo and attach it to your email.

9.2
Failure to file a complaint or contact us in the event of transport damage will not affect your statutory warranty rights or their validity. However, your actions will help us assert our own legal claims against the carrier or any transport insurance you may have.

  • 10 Liability
    10.1
    We are only liable for intent and gross negligence. To the extent that an attributable breach of duty is based on simple negligence and a material contractual obligation (obligations whose fulfillment is essential for the proper execution of the contract, whose breach jeopardizes the achievement of the contract's purpose, and on whose compliance you as a customer regularly rely) is culpably violated, our liability for damages is limited to the foreseeable damage that typically occurs in comparable cases. In the event of injury to life, body, or health, we are liable in accordance with the statutory provisions.

10.2
Liability under the provisions of the Product Liability Act remains unaffected. Otherwise, liability is excluded.

  • 11 Final provisions
    11.1
    Should any provision of these General Terms and Conditions be invalid, the remaining provisions of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.

11.2
German law applies to the conclusion and performance of all contracts. However, this only applies to you as a consumer to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which you have your habitual residence.

11.3
The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.

Obligation to provide information under the Consumer Dispute Resolution Act (VSBG): Amio Germany GmbH declares in advance that it is not willing to participate in dispute resolution proceedings before consumer arbitration boards within the meaning of Section 36 (1) of the Consumer Dispute Resolution Act (VSBG). This does not affect the possibility of dispute resolution by a consumer arbitration board during or in the course of a specific dispute, provided both parties agree (Section 37 VSBG).

The following delivery restrictions apply to the range of goods: see A §5 5.1. Delivery is only possible in household quantities. Orders are only possible for persons aged 18 and over. For freight forwarding items/bulky goods, delivery is free curbside.

3.1 Process of a customer order/offer
If the customer has found a product in the seller's range that meets their requirements, they can place it in their shopping cart. If the customer wishes to view their shopping cart, they can do so at any time by clicking the "Shopping Cart" button. Products that the customer does not wish to order or no longer wishes to order can be changed or deleted at any time by clicking the "Change Item" button (to change the quantity) or "Delete Item" button (to remove the selected item from the shopping cart). After all desired items have been placed in the shopping cart, the customer must enter their data. The seller has appropriately marked the input fields in which the customer must enter their mandatory information for proper order processing. Finally, the customer can click the "Buy Now" button. The Seller accepts the Customer’s offer in accordance with Section 2.2 of the Seller’s General Terms and Conditions (GTC) (see above).

The details of each order and the GTC are automatically sent to the customer via email. After the customer has completed the order by registering, the data can be accessed in the user account. Orders placed without registration can no longer be viewed online after completion.
  2. Information about technical means for detecting and correcting input errors
    Before completing the order, the customer can correct their details at any time. This applies to both the quantity of ordered items and the selected items themselves. To do so, the customer can change their details using the mouse or keyboard, removing items from the shopping cart, and increasing or decreasing the quantity of individual items to be ordered. Furthermore, all order details are displayed again before completing the order, allowing the customer to make corrections.

    Only the German language is available for the conclusion of contracts.
